Fidel Sinclair, the infant’s father, had gone to the hospital that day to meet his 2-day-old son, Nikko, who was being detained in the NICU for monitoring while physicians administered antibiotics.

Prosecutors claim he observed Burke, who had been charged with Nikko’s care, approach the boy, take him up, flip him over, and slam his face down on the bassinet through the nursery window. Sinclair also videotaped the encounter and provided it to the baby’s mother, Consuelo Saravia.

The parents also informed the other nursing personnel at Good Samaritan Hospital about the unsettling footage. Prosecutors said Burke was forced to leave the hospital and dismissed within hours. Tierney said she turned herself into the Suffolk County Police Department on Wednesday and was given a desk appearance ticket for an arraignment in early May.
